A conflict occurs when at least two parties, economically or otherwise dependent, have wholly or partially conflicting interests which cannot be resolved amicably. Traditionally, such a conflict is settled through court proceedings. However, at Caluwaerts Uytterhoeven, we also offer guidance on alternative forms of dispute resolution, such as mediation and arbitration, to resolve conflicts quickly and constructively.
The first and best-known form of dispute resolution is the traditional court procedure. However, in addition to the litigation route, there are several alternative dispute resolution options with which we can also assist you.
Parties are sometimes able to overcome a conflict by negotiating on their own, but this also often fails and can even lead to escalation.
In that case, the parties can seek the assistance of a lawyer who serves as a professional experiential expert to guide and manage the negotiation process. These negotiations can be conducted orally or in writing.
If negotiation fails, the parties can opt for arbitration. This is a method of dispute resolution in which an impartial arbitrator – or a panel of arbitrators – appointed by the parties issues a binding decision on the dispute. We can assist or represent you in arbitration proceedings.
A third alternative dispute resolution method is mediation. A distinguishing aspect of mediation is that the third party does not make the decision, but the parties themselves negotiate and reach a decision with the assistance of a neutral third party – the mediator – who manages the mediation process.
This alternative method of dispute resolution will occupy an increasingly important place in our legal system now that the legislature has given the court the ability to force parties to attempt mediation before proceeding with the case.
